When Opting For An Uncontested Divorce Georgia Couples Will Save Time And Money

It is a sad fact that more and more marriages fail. When this happens, there are always people that are hurt, especially if there are children involved. Statistics show that the rate of marriage break ups is increasing each year. It is especially sad when the parties involved are acrimonious and spiteful. When hate, spite and meanness drive couples to court for a ruling when they separate they often do not fully appreciate the potential consequences. In the first place, this process can be hideously expensive. There are two lawyers involved and they charge a fortune for court appearances. In the second place, the matter is public and anyone has access to all the proceedings.

There are numerous issues involved when a couple separates. The entire process can be stressful, expensive and time consuming. It is certainly better to rather hire the services of a professional to mediate between the two parties. This is cheaper than paying for two lawyers and it is certainly in the interest of both parties to avoid a public spectacle.

When a separating couple agree on mediation they need the services of only one professional. This need not even be a lawyer. They can save money by employing a specially trained counsellor and that is registered to undertake this type of commission. Whatever the decision, it is best to hire someone that knows the laws governing separation and that will act in an objective manner.

A mediator can only be effective if both parties are keen to reach an amicable agreement. If one of the parties refuses to cooperate or displays aggressive behaviour there may be no option other than to contest the case in open court. Experienced and professional mediators will assess the situation before accepting the commission. He will, however, advise the couple on the consequences of a contested separation.

Opting for mediation is cheaper but it is possible to save even more money and time by privately coming to agreement on major issues. Such issues may include matters regarding custody, the division of debt and the distribution of assets. If the couple can present the mediator with their decisions on these matters the entire process can be expedited.

Once the mediation process is completed the mediator will draw up a legal contract stipulating all the agreements reached by the parties involved. This agreement is then presented to a judge who, in most cases, will simply grant the divorce order and make the agreement into a court order. This is done in the privacy of chambers and the agreement is not available for public scrutiny.

Divorcing can be ugly and mean, causing untold misery. This need not be the case, however. Sensible couples will do whatever they can do make sure that their union is dissolved in a private and dignified manner. This can never be achieved if the process is contested on open court.
